Copyright Policy

1. Our Commitment
Kalaloka ("Platform"), operated by DigiYogi, respects the intellectual property rights of creators. We take copyright infringement seriously and will respond promptly to valid complaints about unauthorized use of copyrighted material on our Platform.
This policy outlines how copyright owners can report infringement and how we handle such reports. While India does not follow the U.S. DMCA framework, we adopt a similar notice-and-takedown process as a best practice to protect creators.
2. Reporting Copyright Infringement
If you believe that your copyrighted work has been copied or published on Kalaloka without your permission, you may submit a copyright complaint by sending an email to support@kalaloka.buzz with the subject line "Copyright Complaint".
Your complaint must include the following information:
- Identification of the copyrighted work: Describe the copyrighted work you believe has been infringed. If possible, provide a link to the original work (e.g., a link to the original publication, book listing, or your own website/platform where the work is published).
- Identification of the infringing content: Provide the URL or link to the content on Kalaloka that you believe infringes your copyright. Be as specific as possible (e.g., the story title, chapter, or author profile).
- Your contact information: Full legal name, email address, phone number, and mailing address.
- A statement of ownership: A statement that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- A good-faith statement: A statement that you believe in good faith that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- Accuracy declaration: A statement that the information in your complaint is accurate and that you understand that filing a false or misleading complaint may have legal consequences.
- Your signature: A physical or electronic signature (typing your full name is acceptable).
Incomplete complaints may not be acted upon. We may request additional information before processing your complaint.
3. What Happens After You File a Complaint
- Acknowledgment: We will acknowledge receipt of your complaint within 48 hours.
- Review: Our team will review the complaint and examine the reported content.
- Action: If the complaint is valid, we will remove or disable access to the infringing content promptly (typically within 72 hours of verification).
- Notification to uploader: We will notify the user who posted the content about the complaint and the action taken. The uploader will receive information about filing a counter-notification (see Section 4).
4. Counter-Notification
If your content was removed due to a copyright complaint and you believe the removal was a mistake or that you have the right to use the material, you may submit a counter-notification by emailing support@kalaloka.buzz with the subject line "Copyright Counter-Notification".
Your counter-notification must include:
- Identification of the removed content: Describe the content that was removed and where it appeared on the Platform before removal.
- Reason for dispute: A clear explanation of why you believe the content was removed in error or that you have the right to publish it. This may include:
- You are the original author.
- You have a license or permission from the copyright owner.
- The content is in the public domain.
- Your use qualifies as fair dealing under the Indian Copyright Act, 1957.
- Your contact information: Full legal name, email address, phone number, and mailing address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the courts in Bangalore, Karnataka, India for any legal proceedings related to this dispute.
- Accuracy declaration: A statement that the information in your counter-notification is accurate.
- Your signature: A physical or electronic signature.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a legal action within 14 days, we may restore the removed content.
5. Repeat Infringer Policy
We maintain a strict repeat infringer policy:
- First offense: Content removed, warning issued to the user.
- Second offense: Content removed, temporary account suspension (7–30 days), and monetization privileges may be suspended.
- Third offense: Permanent account termination. All content by the user may be removed.
We track copyright complaints per user. Severe or clearly intentional infringement (such as uploading an entire copyrighted book) may result in immediate permanent ban even on a first offense.
6. Misuse of the Copyright Complaint Process
Filing false or misleading copyright complaints is a serious matter. If we determine that a complaint was filed in bad faith (e.g., to harass a competitor, suppress criticism, or claim ownership of content you did not create), we may:
- Disregard the complaint and restore the content.
- Take action against the complainant's own account on the Platform.
- Pursue legal remedies for damages caused by the false complaint.
7. Indian Copyright Law Reference
This policy operates under the framework of the Indian Copyright Act, 1957 (as amended). Key provisions relevant to our users:
- Section 14: Defines the exclusive rights of copyright owners, including reproduction, communication to the public, and adaptation.
- Section 52: Lists fair dealing exceptions, including private use, criticism, review, reporting of current events, and educational use.
- Section 63: Provides for criminal penalties for copyright infringement.
